These Terms of Service ("Terms") govern your access to and use of Immersia, a real-time tour-sync service operated by E.N.D. Entertainment Corp. ("we", "us", "our"). By creating an account or using the service, you agree to these Terms.
1. Using the service
You must be at least 18 years old and provide accurate information when creating your account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
2. Subscriptions and billing
Paid plans are billed monthly or annually in advance through Stripe. You may cancel at any time from your account page; access continues through the end of the current billing period. Refunds are issued at our discretion. Prices may change with at least 30 days' notice.
3. Your content
You retain ownership of the images, videos, and other media you upload. You grant us a limited license to host, display, and transmit that content for the purpose of operating the service on your behalf. We do not sell or share your content with third parties.
4. Intellectual property
The Immersia platform, including its software, design, trademarks, and documentation, is owned by E.N.D. Entertainment Corp. and protected by applicable intellectual property laws. Your use of the service does not grant you any ownership interest in the platform. You may not copy, modify, distribute, or reverse-engineer any part of the service.
5. Acceptable use
You may not use Immersia to host unlawful content, infringe intellectual property, transmit malware, or attempt to disrupt the service. We may suspend or terminate accounts that violate these rules.
6. Service availability
We aim for reliable uptime but do not guarantee uninterrupted service. Scheduled maintenance, outages of underlying providers (Firebase, Stripe), and force majeure events can affect availability.
7. Liability
The service is provided "as is" without warranty. To the fullest extent permitted by law, our aggregate liability is limited to the amount you paid us in the twelve months preceding the claim.
8. Dispute resolution
Any dispute arising from these Terms or your use of the service will be resolved through binding arbitration administered under the rules of the American Arbitration Association, with proceedings held in Los Angeles County, California. Either party may seek injunctive relief in a court of competent jurisdiction. Claims eligible for small claims court may be filed there instead.
9. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any legal action not subject to arbitration will be brought in the state or federal courts located in Los Angeles County, California.
10. Changes
We may update these Terms from time to time. Material changes are announced by email or in-app notice at least 14 days before taking effect.
